The TCEQ's 2018 Construction General Permit is set to expire, with the renewal becoming effective March 5, 2023. All existing permittees will have 90 days to renew their permits for large or small construction sites. If your construction site will satisfy stabilization requirements prior to the end of the 90 day renewal window, then permit renewal will not be necessary. You will, however, need to file a notice of termination to notify the TCEQ that stabilization has been achieved and no instances of non-compliance have occurred. If your site will not be stabilized before the June deadline, your permit will need to be renewed.
To renew an authorization for a Small Construction Site (between 1-5 acres of soil disturbance), the following needs to occur:
Replace the previous small construction site notice (both primary and secondary operators) with a newly signed 2023 Construction General Permit Small Construction Site Notice (CSN);
Update the SWPPP for the site to insure compliance with the new requirements of the general permit.
To renew an authorization for large sites (5 or more acres of total disturbance), the following needs to occur:
Submit a permit renewal electronically via the TCEQ's STEERs website (it is not necessary to file an NOT);
Pay the permit renewal fee of $225 via credit card through the TCEQ's STEERs website;
Update the SWPPP for the site to insure compliance with the new requirements of the general permit.
All Secondary Operators (typically the project owner/developer) will need to replace the previous Secondary Operator Construction Site Notice with a newly signed 2023 Secondary Operator Construction Site Notice.
